On March 30th, 2023, FAVREL Avocat filed two complaints against France with the European Court of Human Rights. The cases concern the right of persons under guardianship to bequeath their assets. Certain jurisdictions still tend to give priority to the best interests of protected adults over their wishes and preferences, in total contradiction with the convention on the rights of persons with disabilities.
