In the event of loss, injury, or death, the applicable rules are those governing checked property.<\/p><p>From a strictly legal perspective, this approach is understandable. The Convention was drafted at a time when international transport law primarily focused on the movement of passengers, luggage, and cargo. It was not conceived with modern concerns regarding animal welfare in mind.<\/p><p>Yet the legal and social landscape has changed considerably since then.<\/p><p><strong>Animals Are Sentient Beings, Not Mere Property<\/strong><\/p><p>Across Europe, animals are increasingly recognized as beings capable of experiencing pain, fear, stress, and emotional attachment.<\/p><p>Article 13 of the Treaty on the Functioning of the European Union expressly recognizes animals as sentient beings. National legal systems have followed a similar path. In France, Article 515-14 of the Civil Code provides that animals are \u201cliving beings endowed with sentience.\u201d<\/p><p>These developments reflect a profound evolution in the relationship between humans and animals. The law no longer regards animals solely through the prism of their economic value. Their capacity to suffer and their intrinsic welfare are now legally relevant considerations.<\/p><p>Against this backdrop, applying a liability regime designed for property to animals appears increasingly difficult to justify.<\/p><p><strong>Companion Animals Have Become Members of the Family<\/strong><\/p><p>The law must also take into account social reality.<\/p><p>Approximately 40 percent of French households own at least one companion animal. Similar figures can be observed across many European countries. For millions of people, dogs, cats, and other companion animals are not possessions in the ordinary sense. They are members of the family.<\/p><p>They accompany their owners through significant moments of life, provide emotional support, and often occupy a central place within the household. Their loss is experienced not as the disappearance of an object but as the loss of a companion.<\/p><p>When an animal is injured, lost, or dies during air transport, the harm suffered extends far beyond its market value. The emotional impact on the family can be considerable.<\/p><p>This reality is difficult to reconcile with a legal framework that assesses damage primarily through an economic lens.<\/p><p><strong>A Liability Regime That Overlooks Animal Integrity<\/strong><\/p><p>The issue is not merely one of compensation.<\/p><p>The Montreal Convention establishes a liability regime intended to govern damage to transported property. Although the Convention provides mechanisms that may affect the extent of compensation in certain circumstances, its underlying logic remains focused on economic loss.<\/p><p>That logic is ill-suited to situations involving harm to a living being.<\/p><p>When an animal suffers injury during transport, the primary concern should not simply be the financial value of the loss. It should also be the protection of the animal\u2019s physical and psychological integrity.<\/p><p>An animal can experience severe stress, dehydration, trauma, injury, or death during transport. These risks are fundamentally different from those associated with damage to a suitcase or another piece of property.<\/p><p>The current legal framework struggles to reflect that distinction.<\/p><p><strong>Why the Precautionary Principle Should Matter<\/strong><\/p><p>The debate should therefore move beyond compensation and focus on prevention.<\/p><p>European law has long embraced the precautionary principle in situations where significant risks affect important interests. While traditionally associated with environmental protection and public health, its underlying rationale is equally relevant when dealing with sentient beings exposed to foreseeable risks.<\/p><p>Animals transported by air are entirely dependent on the carrier responsible for their care during the journey. They cannot communicate distress, seek assistance, or protect themselves from inadequate conditions.<\/p><p>For that reason, airlines should be subject to heightened obligations of vigilance and prevention when transporting animals. The recognition of animals as sentient beings logically requires the implementation of all reasonable measures necessary to avoid foreseeable suffering, injury, or death.<\/p><p>A legal framework that focuses primarily on compensation after harm has occurred is no longer sufficient. Greater emphasis should be placed on preventing harm in the first place.<\/p><p><strong>Towards a Specific Legal Status for Animals in Air Transport<\/strong><\/p><p>The solution is not necessarily to abandon the Montreal Convention or the uniformity it provides. Legal certainty remains an essential objective of international transport law.<\/p><p>However, it is legitimate to ask whether animals should continue to be governed by rules originally designed for baggage and cargo.<\/p><p>A modernized framework could recognize the specific nature of animals as sentient beings while preserving the Convention\u2019s broader objectives. Such a regime could impose enhanced duties of care on carriers, take greater account of animal welfare considerations, and provide remedies that better reflect the nature of the harm suffered.<\/p><p>The evolution of European law suggests that this discussion is no longer theoretical. As legal systems increasingly acknowledge animal sentience, international transport law will eventually have to confront the implications of that recognition.<\/p><p><strong>Conclusion<\/strong><\/p><p>The recent interpretation of the Montreal Convention by the Court of Justice of the European Union exposes a growing disconnect between international transport law and contemporary understandings of animals.<\/p><p>The issue is not whether the Court correctly interpreted the Convention. It is whether the Convention itself remains adapted to a world in which animals are legally recognized as sentient beings and socially regarded as members of the family.<\/p><p>A legal regime designed for property cannot indefinitely ignore the unique nature of living beings capable of suffering.<\/p><p>The question facing lawmakers is therefore not whether animals are luggage.
