Le tribunal a rejet\u00e9 toutes les demandes du demandeur au motif que le trouble manifestement illicite n\u2019\u00e9tait pas caract\u00e9ris\u00e9 et a condamn\u00e9 l\u2019auteur de l\u2019assignation \u00e0 verser 5000 euros au titre de l\u2019article 700.
Ce genre d’affaire illustre le besoin d’une l\u00e9gislation plus solide pour les proc\u00e9dures initi\u00e9es dans le seul but d’alt\u00e9rer le d\u00e9bat public. On attend avec impatience la transposition de la directive contre les proc\u00e9dures b\u00e2illons.<\/p>
